A man declared himself a “sovereign citizen” to police after he and a woman broke into a Schuylkill County business and ate ice cream from dishes inside, police say.
The man, later identified through fingerprints as Jonathan Fable, 44, who is listed as homeless in court records, initially gave officers a document he called a “Sovereign Citizen ID.” It identified him only as “Jonathan” and listed what he described as a “conceived date” of Oct. 14, 1981, instead of a birth date, according to police.
West Penn Township Police say they were dispatched to Thunderhead Lodge in West Penn Township, around 8:30 p.m. Aug. 4 for a reported burglary in progress.
When an officer arrived, the restaurant’s owners were already on scene with two people detained on the rear deck. The owners showed the trooper surveillance video of a man and a woman walking through the restaurant and taking items, according to police.
Police said the pair got inside by opening an unlocked window in an employee bathroom. Surveillance video from inside the building showed the two walking through the restaurant, opening doors to rooms and refrigerators, according to police. They took sodas from the refrigerator and scooped ice cream into dishes to eat, police said.
The woman identified herself as Emma Emrey, 21, of Parryville, police said.
Fable and Emrey were each charged with two felony counts of burglary, along with felony criminal trespass and misdemeanor theft by unlawful taking, court records show.
Both were arraigned before Magisterial District Judge Christian Lengel early Aug. 5. Fable remains at Schuylkill County Prison, held in lieu of $75,000 bail he was unable to post. Emrey posted $10,000 bail Aug. 6 and was released, records show.
Fable and Emrey have preliminary hearings scheduled for Aug. 18 before Magisterial District Judge Casimir Kosciolek.
