A Schuylkill County man remains in jail after police say he assaulted a woman and broke her phone late last month.
On Oct. 28, police in Pottsville say they were called to the 400 block of E. Norwegian St. after a neighbor heard a man and woman yelling.
At the scene, police say they encountered Jose Rivera, 41, of Pottsville and a female victim.
The woman reportedly told police that Rivera struck her in the face and other parts of her body after she’d confronted him about being out all hours of the night and his persistent drug use.
She also accused Rivera of breaking her phone.
Police say the victim had redness on her arm, a cut to a pinky finger, and redness on her upper chest.
Rivera, when questioned by police, denied hitting the woman but did say he broke her phone and grabbed her as a means of restraining her. He allegedly admitted to breaking the victim’s phone. She did this, he said, because she accused him of having too many friends.
Rivera was arraigned before Magisterial District Judge David Plachko overnight on Oct. 29 and charged with simple assault and harassment. Plachko set bail at $25,000 cash and Rivera was remanded to Schuylkill County Prison. Court records show he remains there, as of Nov. 11. A preliminary hearing is scheduled for Nov. 24.
