Plea Deal Reached with Man Accused of Killing Schuylkill County Business Owner in 2023 with a Dump Truck

Victim’s family, police agree to terms of deal

The Schuylkill County District Attorney’s Office reached a plea deal with Michael Albert last week in the death of West Penn Township business owner Mark Boyle in 2023.

Albert, 62, of White Haven, was facing third-degree murder, aggravated assault, vehicular homicide and other charges for running Boyle over with a dump truck at his business, Mark Boyle Welding and Industrial Sandblasting in August 2023.

Last Friday, Albert agreed to plead guilty to involuntary manslaughter and theft of services. Schuylkill County Judge Christina Hale sentenced Albert to 11½ to 23 months in Schuylkill County Prison, with credit for time served.

Albert was immediately put on parole.

On the theft of services charge, Albert was sentenced to 12 months of probation, to be served concurrently with the involuntary manslaughter penalty.

Albert was ordered to pay Boyle’s family $20,819 immediately on the date of the plea and to have no contact with them.

Case Recap

Albert was upset with Boyle because he wanted a discount on services to repair the dump truck and Boyle did not oblige, according to initial reports. The Lackawanna County man refused to pay for Boyle’s services. An argument between the two then escalated and Albert ran him over with that dump truck.

Albert spent 371 days in Schuylkill County Prison awaiting trial, which was scheduled to begin in September.

However, last Friday, the DA’s office reached a plea deal with Albert. According to a judicial order, Boyle’s family and police investigating the case agreed to terms of the plea agreement.
