A Schuylkill County man who claimed it was a violation of his Constitutional rights to remove his belt and walk through a body scanner before entering the Courthouse appeared in District Court on Monday.
Brach Gibbons, 43, of Orwigsburg, waived his right to a preliminary hearing on Monday. Gibbons is facing two felony counts of aggravated assault against designated individuals and misdemeanor counts of simple assault, resisting arrest, and defiant trespass.
Back on Dec. 22, Gibbons began to empty his belongings into a bin to be scanned at the security entrance at Schuylkill County Courthouse. But when Sheriff deputies wanted him to remove his belt and walk through a body scanner, Gibbons allegedly got angry and violent.
It reportedly took several members of the Schuylkill County Sheriff’s Dept. to subdue Gibbons at the Courthouse as he fought back and hurled profanities at the officers. As he was being forcibly removed from the building in cuffs, Gibbons allegedly kicked one deputy and spit on another.
His case now moves to Schuylkill County Court of Common Pleas.

Charges Held Against Pottsville Man Accused of Breaking Into Residence to Take Items He Says Were Stolen from Him
A Pottsville man accused of breaking into a home to take back items he says were stolen from him had charges against him held for Schuylkill County Court on Monday.
Jaheim Gregory, 23, said he was just trying to get back his stuff when he entered a neighbor’s home. It was actually Gregory that reportedly phoned 9-1-1 to say he was being threatened with a shotgun when he tried entering his neighbor’s home to get back his stuff.
Charges Dismissed or Withdrawn Against 3 of 4 People Involved in Violent New Year’s Eve Party
A second man alleged to be involved in a New Year’s Eve party gone wrong in Pottsville had charges against him dismissed on Monday in District Court.
Antonio Perez, 23, of Allentown, saw charges of aggravated assault, simple assault, and harassment dismissed in his case. Last month, Jose Perez, 49, also of Allentown, saw similar charges against him withdrawn by prosecutors for his alleged role in that New Year’s Eve party on Pottsville’s East side.
A third man allegedly involved, Wilson Caraballo, 24, of Allentown, had illegal gun possession charges against him held for court at a preliminary hearing last month. Caraballo was sent to the hospital after he was reportedly hit in the head with a bottle of Don Julio tequila at that party. While at the hospital, staff there noticed a gun in his possession. It was determined that Caraballo was not permitted to carry a firearm at the time.
The woman who was alleged to have hit Caraballo in the head with the liquor bottle, Aislynn Perez, 22, of Allentown, had aggravated assault, simple assault, and harassment charges against her withdrawn earlier this year, too.
Continuance Granted in Case of Child Sexual Assault
A continuance was granted Monday for the Schuylkill County man accused of child sexual assault. Michael Poslosky, 30, of Pottsville, is facing numerous felony charges, including involuntary deviate sexual intercourse with child. He’s being held at Schuylkill County Prison on $250,000 bail.
Poslosky was arrested last month after an investigation into claims he sexually assaulted two children under the age of 10.

Held for Court
DUI charges against Marcella Marie Corcoran, 58, of Port Carbon were held for Schuylkill County Court of Common Pleas on Monday. Corcoran is facing misdemeanor counts of DUI (3rd offense) and DUI (highest rate) as well as summary counts of driving on a suspended license, careless driving, and accidents involving damage to property in connection with an alleged incident on Nov. 25.
Waived for Court
Anthony William Valentine, 32, of Pottsville waived his right to preliminary hearings in two cases on Monday. In one, he’s facing a charge of possessing a controlled substance. Valentine is charged with theft in a second case against him.
Guilty Plea Entered
Kevin C. Carrington, 46, of Pottsville: A misdemeanor count of possessing a controlled substance was withdrawn and Carrington entered a guilty plea on a count of possessing drug paraphernalia. He was sentenced to probation and ordered to pay $400 in fines and court costs within 30 days.
Charges Dismissed
The following defendants saw their cases dismissed at District Court on Monday:
- Samantha Jo Hahn: Simple assault
- Derrick Reese: Terroristic threats
