Not only was the overturned truck hauling construction debris on Burma Rd. Monday afternoon speeding, it allegedly had numerous safety and records violations, following an on-site inspection.
The safety inspection revealed that the driver did not have a valid CDL. The vehicle had a pair of bald tires and damage to several brake hoses. There were also numerous records violations.
At about 2 p.m. Monday, a tractor-trailer hauling construction debris overturned about a mile away from BRADS Landfill on Burma Rd. in Blythe Township. The driver of the vehicle was cited and fined for speeding and operating a commercial vehicle that overturned.
Jose Manuel Garcia-Bueno, 50, of New York City, was fined more than $2,400 for his role in the crash as the vehicle’s driver.
At the scene, a Level 1 Motor Carrier Safety Assistance Program (MCSAP) inspection was performed on the vehicle by State Police. The results of that inspection have resulted in a dozen violations against the trucking company responsible for the vehicle.
According to records obtained by The Canary, the fines from the violations total $2,704.50 and have been assessed to RT Logistics Corp., of Fort Lee, New Jersey.
Safety Violations
The inspection of the vehicle found numerous safety violations:
Two of the tires on Axle 5 were bald or nearly bald, according to the safety violation citations. The left side inner tire had a tire tread depth of 1/32-inch. The outer tire on the left side was bald (0/32-inch).
Trooper David Cushner, of State Police-Jonestown, who conducted the safety inspection, also noted braking issues.
The right- and left-side service hoses to the service chamber was chafing off the emergency hoses, and vice-versa, on Axle 2.
RT Logistics was also cited for its driver having no record of duty status. There was no federal or Pennsylvania state inspection sticker on the trailer hauling the construction debris.
The license plate on the trailer was damaged and illegible.
A citation was also filed because the commercial vehicle was operating without a legal trade name. Police note that Interstate Waste Services was displayed on the vehicle but the vehicle was operated by RT Logistics.
The company was also fined for failing to correct a safety violation on this vehicle from a previous inspection.
