Truck Hauling Construction Debris Rolls Over on Burma Rd.; Driver Cited and Fined

State Police conduct safety inspection at the scene

A tractor-trailer hauling construction debris rolled over on its side along Burma Rd. on Monday afternoon.

Police have cited the driver – identified as 50-year-old Jose Manuel Garcia-Bueno, of New York City – with speeding and driving on roads laned for traffic. He’s also been cited for operating a commercial vehicle that overturned in an accident.

Garcia-Bueno has been fined a total of $2,445.75.

Police say a Level 1 Motor Carrier Safety Assistance Program (MCSAP) inspection was performed on the vehicle at the crash site. A report from The Canary on the results of that inspection is forthcoming.

Garcia-Bueno sustained minor injuries in the crash that was reported just after 2 p.m. about a mile outside BRADS Landfill in Blythe Township.

The Canary can not confirm through a police report and citations filed in District Court if the truck was definitely en route to BRADS Landfill at the time but it was hauling construction debris and that’s what the dump is designed to accept. Calls to State Police-Frackville to confirm have not yet been returned.

According to citations filed earlier this week at District Court in Port Carbon and through a public information report, Garcia-Bueno was operating a vehicle owned by Cs Corp., of Fort Lee, New Jersey. Cs Corp. has also been cited for an operated vehicle that overturned in a crash due to an equipment violation. A fine for that violation is not yet available.

As he attempted to negotiate a right-hand curve in the road, just south of Fireman Rd., Garcia-Bueno’s truck entered the oncoming lane and rolled over on its side, dumping its load of construction debris.

Police say the truck slid 91 feet on its side before coming to a final rest. Garcia-Bueno was extricated from the vehicle and taken to Lehigh Valley Hospital-East in Pottsville for treatment of his injuries.

Hammer’s Towing, of Minersville, responded to the scene and removed the crashed vehicle and trailer and collected the spilled debris, police say.
