Schuylkill County Man Accused of Destroying Disabled Child’s Bicycle Sent Back to Jail at Preliminary Hearing

Sherwood deemed a threat to community safety

A Schuylkill County man was sent back to jail Tuesday afternoon at his preliminary hearing on charges he destroyed a disabled child’s bicycle during an argument earlier this year.

Magisterial District Judge David Plachko imposed a new, higher bail on Kiyone Sherwood, 19, of Saint Clair, at the request of Assistant District Attorney David Noon. Bail had been set at 10% of $2,500 following Sherwood’s arrest following an alleged incident at Adm. Boone Park in Saint Clair back on Aug. 12.

Sherwood is accused of throwing the bicycle of a then 14-year-old boy who he had engaged in a verbal argument that turned physical. During that argument, Sherwood allegedly threw the child’s bicycle, rendering it unusable.

After his initial arrest, Sherwood posted the $250 to get out of jail but on Tuesday, Plachko modified bail to 10% of $25,000 and sent Sherwood to Schuylkill County Prison because he could not post it immediately.

Before sending Sherwood on his way, Plachko gave several stern warnings to him.

Plachko said he was justified in raising the bail amount on Sherwood not so much because he’s a flight risk but, due of the nature of the accusations, because he’s a safety risk to the Saint Clair community.

“These are absolutely innocent people just trying to enjoy some sense of normalcy in their lives,” Plachko told Sherwood.

Sherwood then made the mistake of speaking when it was not his turn to speak. He had previously turned down an opportunity during his preliminary hearing to testify on his own behalf or question several witnesses called by prosecutors.

“This kid came at me,” Sherwood said.

Sherwood then said he would show Plachko a video proving his side of the story the next time he’s in his court. Since charges against Sherwood were held over for Schuylkill County Court of Common Pleas, this would be the last time, at least in this case, that he’d appear before Plachko as it relates to this case.

“There had better not be a next time you come to this court,” Plachko warned.

The judge added that if Sherwood “directly or indirectly through your crew” come into contact with the victim or any witness involved in the case, “the full force of the criminal justice system and the Saint Clair Police force will come down on you so swiftly.”

Witnesses Recount Day of Incident

During Tuesday’s hearing, several witnesses took the stand to offer their side of what happened on Aug. 12.

A family member of the victim testified that she remembers him coming home that day pushing his bicycle. The rear tire and brakes were destroyed.

“He was very upset,” she said.

She said the victim was disabled in an accident several years ago and it was revealed during Tuesday’s hearing that he has no function of his left arm and limited function in his left leg. He also suffers from a seizure disorder and wears a special magnet device that’s supposed to be used during a seizure.

She said she was told that an argument between the victim and Sherwood started over music being played loudly. Sherwood followed the victim to the park and that’s when the argument escalated.

Don Tucker, who said he lives directly across the street from Adm. Boone Park, said he and his wife, who are both retired, were sitting on their porch the day of the fight. He said Sherwood was shoving the victim around but never pushed him to the ground.

Tucker testified that as the victim was leaving the park, Sherwood grabbed his bike and threw it.

An unidentified person allegedly threw the victim’s seizure magnet, too.

Tucker said he attempted to break up the argument and that’s when Sherwood allegedly tried to fight him.

“He called me a n—-r and everything else. I said, ‘Let’s go’,” Tucker said.

That led to a shouting match for about 10 minutes before police arrived, he recalled on the stand. During that time, Sherwood was continually trying to instigate the retired man into a fight.

“He was ready to go. It was only going to take one swing and it was going to be on,” he added. “You don’t want me to repeat the things he was saying.”

Saint Clair Police officer Tim Walsh also testified Tuesday. He accounted for the extent of the damage to the victim’s bicycle and said Sherwood attempted to fight the victim, which caused him to get upset.

In describing the victim’s physical condition, he said, “He might be 15 but he looks like he’s about 8.”

Sherwood has been charged with misdemeanor counts of marijuana possession, disorderly conduct, and criminal mischief. He’s also facing two summary offenses for harassment.

    Another fine import to Schuylkill County. No doubt he will be registered by the Demonrat party to vote for more of this.
