A Schuylkill County woman is facing a felony burglary conspiracy charge police say she was one of three people who forced their way into a Mechanicsville home and then kept the woman who lives there from getting back inside.
Nicole Ervolino, 43, of Pottsville, was arraigned Tuesday, Sept. 1, on five counts stemming from the Feb. 27 incident, along with co-defendants Katie Serrano, 30, of Pottsville, and Tony Fordham.
The three went onto the property on Port Carbon St. without permission, police say.
Fordham kicked in the resident’s door and entered the home, causing about $550 in damage, according to police.
Serrano and Ervolino then stood between the door and the woman who lives there, refusing to let her into her own residence, police say.
The woman who lived at that address told all three to leave several times, and they refused. They left only after she called 9-1-1.
Police say they initially canvassed the area for the three but did not find them.
Ervolino is charged as a conspirator rather than as the person who forced the door. She faces one count of conspiracy to commit burglary of an overnight accommodation with a person present, a first-degree felony; conspiracy to commit criminal trespass, a second-degree felony; conspiracy to commit criminal mischief, a third-degree misdemeanor; defiant trespass, a third-degree misdemeanor; and a summary count of criminal trespass.
Magisterial District Judge Edward Lewis set her bail at $500 monetary at her arraignment. Ervolino was committed to Schuylkill County Prison that day and was released Thursday, Sept. 3, after the $500 was posted.
Serrano is charged directly with burglary of an overnight accommodation with a person present, a first-degree felony, along with criminal trespass, a second-degree felony; criminal mischief and defiant trespass, both third-degree misdemeanors; and a summary count of criminal trespass. She is awaiting a preliminary hearing.
Both women are scheduled for preliminary hearings before Lewis on Oct. 13.
Fordham waived several charges to Schuylkill County Court of Common Pleas earlier this year. The burglary and criminal trespass counts against him were withdrawn. His case remains pending.
