A Schuylkill County man faces charges including aggravated assault on a law enforcement officer after State Police say he threw a wooden stake at a Trooper, breaking the officer’s thumb, during an attempted mental health commitment on Monday.
Carl Daubert, 34, of Washington Township, is being charged with two felony counts of aggravated assault on a law enforcement officer, and misdemeanor counts of simple assault and resisting arrest. He has not yet been arraigned on these charges.
Police say they were called to a home in Rock shortly after 2:30 p.m. on April 6. Family members told police Daubert had a history of mental health issues, was under the influence of methamphetamines, and speaking incoherently. Prior to police arrival, Daubert told family members he was going out to the garage to put screws into a stick, police say.
Officers made contact with Daubert in an open garage on the property, while other police remained with family on the porch. An involuntary mental health commitment warrant was approved while police were on the scene, but when Troopers attempted to serve it, Daubert began acting erratically upon hearing the term “302,” police say.
Daubert reportedly said he would not comply with the commitment and grabbed a small green propane torch and a two-foot long wooden stake before exiting through a side door, police say.
Once outside, Daubert retreated backward and ignored verbal commands, police say. He made an instigating and threatening statement and called a Trooper a racial slur, police say.
As Daubert ignored commands and retreated, a Trooper deployed a Taser in an attempt to gain control, police say. The attempt was unsuccessful, and Daubert ran away from police through an unlit burn pit in the yard.
While running, Daubert threw the stake at a Trooper, striking his right hand, police say. Daubert was eventually taken into custody.
The injured Trooper sought medical treatment at Geisinger St. Luke’s Hospital, where police say he was treated for a broken bone in his right thumb.
