Trick-or-Treat No-Go List Leads to Megan’s Law Charge Against Schuylkill County Woman, Police Say

Aunt’s address listed, police say

Brittany Marks

A Schuylkill County woman is in jail after State Police say she registered her aunt’s Frackville home as her address on the Megan’s Law registry, a home her aunt says she has never lived in.

Brittany Marks, 34, of Frackville, is charged with a felony count of failing to provide accurate registration information.

Marks’ aunt went to the State Police barracks in Frackville on the morning of Oct. 30 and told a trooper that, the evening before, she had seen her address in a public Facebook post listing sex offender residences for trick-or-treaters to avoid, police say.

The woman told police Marks is an active registrant with the State Police Megan’s Law Section. When she checked the public Megan’s Law website, she found Marks’ primary address listed as her home in the 100 block of S. Railroad Ave.

She told police Marks has never lived there and that she never gave Marks permission to use the address.

A check of the State Police Megan’s Law database showed Marks reported the S. Railroad Ave. address as her primary address on Oct. 9, according to police.

Marks’ registration stems from a 2017 case in which Pottsville police charged her with statutory sexual assault and related offenses, saying she had sex with a 15-year-old boy in 2015.

Marks was arraigned Monday afternoon before Magisterial District Judge Edward Tarantelli, who set bail at $10,000. Unable to post bail, she was taken to Schuylkill County Prison.

Her preliminary hearing is scheduled for Nov. 25 before Tarantelli.
