A Schuylkill County man is accused of indecently assaulting an 11-year-old child while rubbing the child’s back in July.
Brian Nester, 54, of Pottsville, faces two counts of indecent assault of a person less than 13 years of age, along with one count each of corruption of minors and endangering the welfare of children. All charges are misdemeanors.
An adult went to the State Police barracks in Schuylkill Haven on July 23 to report that the child had been assaulted on July 17, police say. The adult told police the child called that day, said Nester had touched them inappropriately, and asked to be picked up. The adult told police they went and got the child right away.
A forensic interview was then scheduled for Aug. 18 at the Child Advocacy Center in Harrisburg. Before the interview, a protection from abuse order was put in place against Nester to protect the child, police say.
During the interview, the child said Nester touched them inappropriately, including under their clothing, while giving them a backrub, according to police. The child pushed Nester’s hand away, police say.
The child then went to a room, blocked the door and called an adult to come pick them up, police say.
Nester was charged by summons. He is scheduled for a preliminary hearing on Oct. 27 before Magisterial District Judge Casimir Kosciolek.
