What the law says
Under the Public School Code, the remaining board members have 30 days from the vacancy to appoint a replacement by majority vote.
If they don't
Ten or more resident taxpayers of the district — not one — may petition the Schuylkill County Court of Common Pleas to have a judge appoint someone.
The weekend and Labor Day
Day 30 lands on a Friday, so it stands — under 1 Pa.C.S. § 1908, a deadline falling on a weekend or legal holiday rolls to the next business day, but that doesn't help here. The courthouse is closed Saturday and Sunday, and Monday, Sept. 7 is Labor Day. The first day a petition can actually be filed is Tuesday, Sept. 8.
The board isn't locked out
Missing the deadline opens the courthouse door; it doesn't strip the board of its power. The board can still act until a judge appoints.
How long the seat is held
Whoever is appointed serves until the first Monday of December 2027. The rest of the unexpired term goes on the November 2027 ballot.
